(RE)PENSAR A RESPONSABILIDADE CIVIL: O DIREITO DE DANOS A PARTIR DO DIREITO CIVIL-CONSTITUCIONAL NO BRASIL

O presente artigo visa a analisar o desenvolvimento da responsabilidade civil no Brasil desde o seu primeiro Código Civil até a contemporaneidade. O objetivo da análise é verificar os aspectos sociais que embasaram cada modelo de responsabilidade e as transformações jurídico-filosóficas destes modelos em referência às mutações da sociedade em que estavam inseridos, em um determinado espaço tempo. A análise proposta foi realizada através investigação histórico-jurídica. Uma vez estabelecidos os caracteres de cada modelo de responsabilidade em seu tempo e espaço, buscou-se aplicar o modelo de responsabilidade por danos contemporânea ao problema da pragmatização do dano, com coerência teórica e respeitando os pressupostos jurídico-filosóficos estabelecidos. Nesse aspecto a pesquisa se desenvolveu através da linha crítico-metodológica com uso do raciocínio dedutivo. As premissas extraídas do modelo de responsabilidade contemporâneo identificado foram aplicadas no problema da pragmatização dos danos. Foi identificada a incoerência teórica da função punitiva com a responsabilidade por danos e que há possibilidade de utilização da teoria do lucro de intervenção e da prevenção como instrumentos de neutralização do fenômeno combatido.
