Fontes das obrigações e regimes jurídicos obrigacionais gerais: em busca do papel da vedação ao enriquecimento sem causa no direito civil contemporâneo

O escopo central do presente estudo consiste na investigação do papel desempenhado pela vedação ao enriquecimento sem causa no quadro geral de fontes das obrigações. A investigação se desenvolve a partir da análise crítica de material bibliográfico da doutrina brasileira e da doutrina de outros países de expressiva influência sobre a conformação dogmática da teoria das fontes das obrigações no direito pátrio. Inicia-se, assim, de um breve relato da positivação da vedação ao enriquecimento sem causa pelo Código Civil de 2002. Na sequência, diferenciam-se conceitualmente as fontes das obrigações e as fontes do direito, com o que se possibilita a proposta de revisitação da doutrina tradicional das fontes das obrigações. Perquire-se, então, o papel tradicionalmente desempenhado pela vedação ao enriquecimento sem causa na doutrina brasileira das fontes das obrigações. Por fim, investiga-se o escopo contemporâneo do estudo das fontes das obrigações, com particular destaque para a vedação ao enriquecimento sem causa. O percurso trilhado permite concluir, ao final, que a mais destacada utilidade contemporânea do estudo das fontes das obrigações consiste no reconhecimento da existência de regimes jurídicos obrigacionais gerais, entre os quais se situa o regime restitutório atrelado à vedação ao enriquecimento sem causa.Downloads
