APERFEIÇOAMENTO DO SISTEMA JURÍDICO BRASILEIRO A PARTIR DO PRECEDENTE JUDICIAL: A “RATIO DECIDENDI” DA SÚMULA VINCULANTE N° 11

O presente texto analisa técnicas adotadas nos sistemas da “common law” e da “civil law” para a garantia da uniformização do entendimento jurisprudencial. Após, examina o instituto das súmulas vinculantes e a utilização de mecanismos próprios do precedente judicial, em especial, a “ratio decidendi” para o aperfeiçoamento da construção e aplicação das súmulas. Assim, analisar-se-á a súmula vinculante n° 11, verificando sua redação e os casos que embasaram sua criação, a fim de compreender e delimitar os requisitos para sua aplicação, implicando em uma segurança jurídica aos jurisdicionados e previsibilidade em sua aplicação, não ficando à mercê da consciência de cada julgador de forma solipsista. O objetivo desta pesquisa é buscar, na cultura da “common law”, critérios da “ratio decidendi” que gerem maior confiabilidade na aplicação da referida súmula, além de propor uma nova redação para a súmula. A metodologia utilizada é de caráter dedutivo a partir de pesquisa doutrinária e jurisprudencial, inclusive originária da cultura da “common law”. É esperado chamar atenção dos operadores do direito para a importância do debate sobre a necessidade de estabelecer critérios objetivos para a aplicação da Súmula Vinculante nº 11.
