Efetivação da proteção ambiental: análise da contratação direta do estudo de impaco ambiental pelo proponente de projetos

Irregularidades na máquina estatal, consequentes de crimes ou simplesmente da inabilidade na gestão dos interesses públicos, não surpreendem. Para redução de sua incidência, expedientes jurídico-normativos devem ser criados. Necessário que o Estado opte por meios, dentre os disponíveis, mais capazes de realizar seus objetivos. Exigem-se eficácia e eficiência, a envolver criação de medidas que diminuam riscos e elevem as chances de efetividade. Na seara ambiental, apenas atribuição de responsabilidade aos infratores é insatisfatória a tutelar o direito à proteção ambiental. Quando da realização do Estudo de Impacto Ambiental, exigem-se medidas inibitórias a pressões sobre seus elaboradores. Insuficiente a mera confecção do trabalho técnico. Neutralidade e regularidade procedimental devem ser constantes. O Estudo, além de direcionar-se à sustentabilidade do desenvolvimento, por si só, também é direito-garantia. Visando à sua lisura, deve haver independência jurídica e também econômica entre o elaborador e o contratante do trabalho, conquanto caibam a este as despesas de sua execução. Para coibir pressões sobre o realizador do trabalho, a solução mais adequada a dar efetividade aos fins do Estudo parece ser a interferência do Estado no ato de transferência do valor relativo ao preço de confecção daquele, no caso de o proponente de projeto ser particular.
