O BENEFÍCIO ASSISTENCIAL DE PRESTAÇÃO CONTINUADA E O PLENO DO SUPREMO TRIBUNAL FEDERAL

O estudo delineou o posicionamento do Pleno do Supremo Tribunal Federal (STF) no período de 2006 a 2016 no tocante ao Benefício Assistencial de Prestação Continuada (BPC). O foco da pesquisa foram a interpretação e o alcance dados pelo STF ao artigo 20 da Lei nº 8.742/1993, conhecida como Lei Orgânica de Assistência Social (LOAS) e como o Plenário da Corte Constitucional solucionou a tensão existente entre a efetivação dos direitos sociais, a tese da reserva do possível e o recorte de renda imposto como critério de elegibilidade ao benefício previsto pela LOAS.
A metodologia utilizada foi à descritiva, realizando-se análise documental, por meio do estudo dos acórdãos proferidos pelo plenário do STF.
Os resultados encontrados indicam a existência de 08 acórdãos acerca do tema, que permitiram concluir que o STF solucionou a tensão existente entre a efetivação dos direitos sociais e a tese da reserva do possível, ao considerar que o recorte de renda imposto como critério de elegibilidade ao benefício previsto pela LOAS é inconstitucional incider tantum, sem declaração de nulidade, e que devem prevalecer o princípio da dignidade da pessoa humana e os objetivos da Lei Maior sobre a tese da reserva do possível.
