NOTAS SOBRE OS DIÁLOGOS COM A CIDADANIA: A RELAÇÃO ENTRE INSTITUIÇÕES PÚBLICAS E SOCIEDADE CIVIL COMO VETOR PARA A INTERPRETAÇÃO DA CONSTITUIÇÃO.

O presente estudo tem por objetivo defender a existência de uma forma específica de interação entre as instituições públicas e a sociedade civil, identificada com as associações civis e os movimentos sociais, que tem como resultado a produção de sentidos para a Constituição. Tal fenômeno foi identificado pelo conceito de “diálogos com a cidadania”, tendo a pretensão de abranger as hipóteses nas quais o Estado e a sociedade civil interagem por meio das chamadas interfaces socioestatais, espaços de concretização de direitos com ampla participação de movimentos sociais e associações civis. A necessidade de propor um tal conceito surge como uma tentativa de complementar as deficiências identificadas nas teorias tradicionais dos diálogos institucionais, as quais, muito embora incluam a sociedade civil como um ator constitucional no âmbito dos diálogos, limitam seu papel a de um agente coadjuvante nas interações entre os poderes. Dessa maneira, essa concepção não é capaz de oferecer um aparato conceitual capaz de explicar a produção dialógica de sentidos da Constituição que se dá no âmbito da “participação institucionalizada”, marca característica da Constituição de 1988. Por essa via, defende-se a existência de outro campo de estudos relacionado às teorias dialógicas que ultrapassa as fronteiras tradicionalmente demarcadas pelas teorias dos diálogos constitucionais. A partir desse novo campo, dos diálogos com a cidadania, propõe-se uma nova agenda de pesquisa que possui tanto uma dimensão empírica quanto uma normativa.
