PROVISIONAL MEASURE: an urgent and relevant subject

This work craves to analyze not only the importance of the Provisional Measure in the national legalsystem, but also the legal discussions underlying this institute nowadays. Initially, we will focus onhistorical aspects that led to its creation. Then, the study will look into the legal aspects of thisnormative act, and in addition, a detailed analysis of urgency and relevance requisites for the issuingof Provisional Measures will be made. The possibility of the use of this legal instrument by otherfederal entities, namely, states and municipalities will be also verified. Finally, the advantages anddisadvantages concerning the institute will be explored, in order to assess its current importance andcompatibility with the principle of separation of powers.
