O presente trabalho tem por escopo a partir de um dado percurso histórico, desde a experiência romano-germânica até o movimento codificador moderno apontar o que há ainda de moderno no processo civil atual, bem como, a sua condição esquizofrênica entre modernidade e hipermodernidade. Tal esquizofrenia dá-se pela assunção de um novo vetor de racionalidade á operar a lógica processo-jurisdicional, qual seja, a eficiência, base do movimento de neoliberalização do(s) sistemas(s) de justiça. Nesse viés, aponta-se ao final do trabalho um caminho hermenêutico a ser trilhado, de reaproximação do processo aos conteúdos democrático-constitucionais, recolocando-o no mundo e, construindo-o hermeneuticamente adequado à sociedade contemporânea.
