ACESSO À JUSTIÇA EM TEMPOS DE PANDEMIA E OS REFLEXOS NOS DIREITOS DA PERSONALIDADE

O presente trabalho tem por objetivo analisar possíveis mutações ou ampliações ao princípio constitucional do acesso à justiça em tempos de Covid-19 e os impactos aos direitos da personalidade, com foco em minorias e grupos vulneráveis. Em tempos de pandemia, a garantia de acesso à justiça, em especial, transmutou-se grandemente para utilização da tecnologia como instrumento de conexão entre as partes conflitantes. Neste ínterim, destaca-se a Resolução nº 313, de 19 de março de 2020 do CNJ, bem como a recente Lei nº 13.994, de 24 de abril de 2020. Como resultado, percebe-se que a tecnologia impacta no acesso à justiça de grupos vulneráveis, seja pelo agravamento das vulnerabilidades em decorrência da pandemia, seja por dificuldades relacionadas com a ausência de habilidades tecnológicas para manuseio das ferramentas virtuais de acesso, destacando-se nesse grupo os denominados analfabetos digitais. Para tanto, utiliza-se o método hipotético-dedutivo, por meio de pesquisa bibliográfica para dedução da proposta.
