CONSTITUINTE EXCLUSIVA, POLÍTICA E DEMOCRACIA: um ponto de vista da filosofia do direito

DOI: 10.12957/rfd.2017.29252No ano de 2013, o governo federal brasileiro, por meio da presidenta Dilma Roussef, propôs a realização de um plebiscito a fim de convocar uma constituinte exclusiva para realizar a reforma política. Tal proposta sofreu várias críticas tanto de políticos da oposição como de alguns juristas. O presente artigo argumenta favoravelmente à proposta de uma constituinte exclusiva. Em relação ao aspecto político, utiliza fundamentos teóricos da democracia radical – Ernesto Laclau e Chantal Mouffe – para reconhecer que o espaço político é o campo do genuíno antagonismo e da articulação das demandas populares e que, por isso mesmo, nada mais adequado do que a reforma política, ou seja, a decisão sobre a política da política, se realize a partir da participação direta da população e, por isso, a importância do plebiscito. No aspecto jurídico sustenta que não há nenhuma contradição no reconhecimento de limites para uma assembléia constituinte e, nesse sentido, uma constituinte exclusiva não é, ontologicamente, menos poder constituinte. Usa elementos da Metafísica de Aristóteles para o argumento ontológico. Por fim, sugere que a assembléia nacional constituinte exclusiva para a reforma política seja realizada por meio de representantes que não sejam escolhidos apenas entre os políticos profissionais, mas de movimentos sociais e outros canais de participação popular.
