Resumo

O artigo procura extrair elementos para a crítica do direito à luz da Dialética negativa de Theodor W. Adorno. O aporte teórico realizado pelo autor permitiu que o pensamento dialético se ajustasse às questões filosóficas postas pelo Século XX, como a denúncia dos grandes sistemas e das metanarrativas. A crítica do paradigma de identidade, cuja origem remonta aos circuitos econômicos de trocas de equivalentes, permite uma aproximação relativamente original no que concerne à figura do sujeito de direito. Assim, a partir dos modelos apresentados pelo autor na terceira parte de sua obra, busca-se desenvolver certas reflexões epistemológicas no contexto de algumas categorias próprias à sua dialética, com vistas a uma compreensão mais adequada do momento normativo do fenômeno jurídico. Os resultados apontam para uma ampliação dos espaços críticos do fenômeno jurídico no interior da tradição dialética.

Abstract

The article seeks to extract elements for the critique of the law in the light of Theodor W. Adorno's Negative Dialectic. The theoretical contribution made by the author allowed dialectical thinking to adjust to the philosophical questions posed by the 20th century, such as the denunciation of the great systems and metanarratives. The criticism of the identity paradigm, whose origin goes back to the economic circuits of exchange of equivalents, allows a relatively original approach with regard to the figure of the subject of right. Thus, based on the models presented by the author in the third part of his work, we seek to develop certain epistemological reflections in the context of some categories specific to his dialectic, with a view to a more adequate understanding of the normative moment of the legal phenomenon. The results point to an expansion of the critical spaces of the legal phenomenon within the dialectical tradition.
