On the Distinction Between Legal Form and Form of Law in Stutchka and Pachukanis

In this paper, we present a translation hypothesis about Pachukanis’ work that has been standardized by translators, theorists and editors. It is a distinction between the expressions “forma prava”, “pravovaya forma” and “yuriditcheskaya forma”, usually translated as “legal form”. As suggested by the etymological origins of each word, we anticipate that the first two terms allude to a more global dimension of law, while the latter relates to more concrete and empirical manifestations of everyday legal experience. We put this perception to the test by comparing the originals and the translations of emblematic chapters of the main works of Piotr Stuchka and Evgeny Pashukanis. Based on this analysis, the texts corroborate the initial hypothesis by associating the noun “pravo” and the adjective “pravovoi” with the apprehension of the totality of the legal being in its maximum degree of abstraction, while the adjective “yuriditcheskii” appears associated with phenomenal, concrete and empirical manifestations and expressions of this finished legal form.
