Resumo
O abolicionismo penal refere-se à substituição do sistema penal por outras formas de resolução dos conflitos, ou seja, é uma política criminal com a pretensão de eliminar o ordenamento jurídico penal e o aparato punitivo. Pretende-se elaborar uma crítica, a partir das perspectivas efetuadas por Louk Hulsman e por Nils Christie, no sentido de demonstrar que qualquer eventual forma abolicionista, substituta do direito penal, não deixaria de ser determinada pelas relações de produção, análise esta realizada a partir dos apontamentos de Pachukanis. Isto porque, conforme a hipótese desta pesquisa, ao identificar à forma mercantil a forma jurídica, os conceitos de delito e de pena, mesmo em suas novas configurações dadas pelos abolicionistas, ainda estarão ligadas àquelas formas, das quais se libertarão somente com a alteração do modo de produção social, do contrário ainda existirão segundo a lógica do sistema jurídico e do sistema capitalista, que manterão sua força e significação.

Abstract
Penal Abolitionism refers to the substitution of penal system for other forms of conflict resolution, i.e., it is a criminal policy with the intention of eliminating the legal penal system and the criminal punitive apparatus. This research aims to criticise, from the perspectives made by Louk Hulsman and Nils Christie, that any alternative presented by Abolitionism to the criminal system would continue to be determined by the social relations of production, that can be observed analysing the points risen by Pachukanis. When one, in accordance with the hypothesis of this research, identifies the legal form to the mercantile form, the concepts of crime and punishment, even though under their new settings given by the abolitionists, will still be connected to those forms, from which will be released only if the social mode of production is changed, otherwise they will still remain under the logic of both the legal system and capitalism, that will maintain their strength and significance.
