Resumo

O artigo pretende compreender a disputa que ocorreu na Assembleia Nacional Constituinte sobre o desenho institucional das Forças Armadas no novo marco constitucional, a partir dos trabalhos da Subcomissão Temática. A pesquisa analisou fontes primárias dos arquivos históricos da Constituinte, sob a ótica da Análise do Discurso. A análise sugere uma disputa entre o discurso de continuidade da Doutrina da Segurança Nacional e a necessidade de submeter as Forças Armadas aos poderes constitucionais.

Abstract

The article intends to understand the dispute that occurred in the National Constituent Assembly over the institutional design of the Armed Forces in the new constitutional framework, based on the work of the Thematic Subcommittee. The research analyzed primary sources from the Constituent historical archives, from the perspective of Discourse Analysis. The analysis suggests a dispute between the continuity discourse of the Doctrine of National Security and the need to submit the Armed Forces to constitutional powers.

Vanessa Dorneles Schinke, Universidade Federal do Pampa (UNIPAMPA)

Professora de Direito Penal e Processo Penal na Universidade Federal do Pampa. Doutora em Ciências Criminais pela PUCRS, com período sanduíche na King´s College London, sob orientação do prof. Anthony Pereira. Mestre em Direito, Estado e Constituição pela Universidade de Brasília (UnB). Especializada em “Políticas Públicas y Justicia de Género”, pelo Consejo Latinoamericano de Ciencias Sociales (CLACSO), Argentina. É pesquisadora associada à Rede de Pesquisa Empírica em Direito (REED). Dedica-se a pesquisas sobre permanências e novas gramáticas autoritárias do Poder Judiciário e sobre o funcionamento do sistema de justiça criminal e suas interseccionalidades diante de reivindicações de grupos subalternizados, com as variáveis gênero, raça e sexualidade.
