Este artigo propõe um diálogo entre o conceito de cuidado como categoria central para o convívio social, desenvolvido especialmente por autoras feministas, e o conceito de subordinação no campo do Direito do Trabalho. Para propor a superação da falácia da autonomia individual, desde o reconhecimento do cuidado como questão coletiva e fundamental, o artigo tratará brevemente do projeto da modernidade, em que o Direito do Trabalho se inscreve. Em seguida, procurará demonstrar como as normas trabalhistas são, ao mesmo tempo, acomodação e tensionamento desse projeto. Para, a partir disso, discutir a importância do cuidado como fator decisivo para compreendermos o elo entre a noção moderna de sujeito de direitos e as possibilidades de reconstrução dos fundamentos dos laços sociais que justificam a regulação jurídica na troca entre capital e trabalho, especialmente a partir da ressignificação da categoria da subordinação.

Abstract

This paper proposes a dialogue between the concept of care as a central category for social coexistence, developed especially by feminist authors, and the concept of subordination in the field of Labor Law. To propose surpassing the fallacy of individual autonomy by recognizing care as a collective and fundamental issue, the article will briefly address the project of modernity, in which Labor Law is inscribed. Then, it will try to demonstrate how labor norms are, at the same time, accommodation and tensioning of this project. Based on this, we discuss the importance of care as a decisive factor in understanding the link between the modern notion of subject of rights and the possibilities of reconstructing the foundations of the social ties that justify legal regulation in the exchange between capital and labor, especially from the redefinition of the category of subordination.
