Abstract

O presente estudo visa discorrer acerca da aplicação do princípio da dignidade da pessoa humana na hermenêutica jurídica contemporânea, sob a luz do pós-positivismo, abordando a origem e evolução histórica sobre tal princípio e pelo próprio Direito para chegar ao atual modelo principiológico que segue e vincula todo o ordenamento jurídico contemporâneo.

Abstract

The present study contemporary aims at to discourse concerning the application of the beginning of the dignity of the person human being in the legal hermeneutics, under the light of the one post-positivism, approaching the origin and historical evolution on such principle and for the proper Right to arrive at the current study of the principles model that all follows and ties to the legal system contemporary.

Christiane Splicido

A autora é graduada em Direito pela Instituição Municipal de Ensino Superior de Assis/SP. Pós-graduada em Direito Aplicado pela Escola da Magistratura do Paraná (núcleo de Londrina/PR). Também, pós-graduada em Direito Previdenciário pela Universidade Anhaguera - UNIDERP. Ainda, é Mestre em Teoria do Direito e do Estado pelo Centro Universitário Eurípides de Marília. Atualmente, é Professor Universitária na Faculdade do Vale do Juruena – AJES, Juína/MT, Brasil, 2012.
