Abstract

Psychological care in court has been a practice in voluntary adoption processes, determined in the Child Statute and specified in normative and technical guidelines by the National Council of Justice. From the attendance of a pregnant woman, victim of rape, a case study was carried out based on the approach of the records of the attendances and clinical diary, based on a Psychoanalytic theoretical framework. The aim of this study was to reflect about the possibilities of a psychoanalytical listening of a pregnant woman in the judicial context of the Voluntary Delivery Program. The analysis enabled the understanding that listening must be based on a sociopolitical reading and consider the subject's position in the social bond. It is essential to apprehend the political issues that involve voluntary surrender for adoption, in addition to the conditions of exclusion, helplessness and impotence that operate in silencing pregnant women, maintaining the oppressive process that affects them. Finally, the debate on this issue in the judicial context opens up possibilities for a broader discussion of issues related to women and their rights, such as the expansion of public policies, aspects of intersectionality, the prevention of violence and the guarantee of legal abortion for all women.
