Abstract

Underlying this paper is the “new” reality that procedural law must face in the twenty-first century. The issue of sources, of procedural codification, will be analyzed to see the positive law tools available to address today’s procedural challenges. The work is complemented with a reference to procedural agreements and their ability to adapt general procedural solutions to the needs of the specific case. Finally, it concludes with contributions linked to the idea of simplicity as an essential characteristic of contemporary procedural law. Simplicity that should be appreciated in its rules, in the procedural structures, in its functions, etc., seeking to strengthen its role as a guarantee.
