ASSUMPTIONS OF ADEQUATE SELF-COMPOSITIONAL MEASURES TO RESOLVE CONFLICTS: EFFECTIVE ACCESS TO JUSTICE

The inclusion of the preliminary self-composition hearing (art. 334) of the Civil Procedure Code, as well as the duty to encourage self-composition by law operators (§3, article 3 of the CPC) transmutes it into a plural judicial policy. Thus, the organization of methods eligible for conflicts lacks systematization as adequate measures for conflict resolution. The present study aims to analyze the assumptions common to any self-compositional measure in the processes taken to the judicial function. The present article aims to understand the assumptions to be observed in the multiple autocompositional methods to consider an adequate (autocompositional) measure of conflict resolution. The problem that we intend to answer is whether the current use of selfcomposition measures obeys the procedural constitutional principles of access to justice. Still, it is sought in the present to analyze the impact of self-composition on the judiciary, considering the satisfaction of the parties and the public administration in general. There are common assumptions applicable to all methods, because only scientifically proven methods should be considered suitable for use in the Judiciary, keeping these from the beacons of the scientific method. Self-composition measures as a broad measure are relatively recent, and still understood as merely alternatives, and the Judiciary should be cautious as a developer and applicator of new methods, or methods with low caution or lacking scientific data. The investigation methodology had a qualitative and quantitative bias, with an exploratory, descriptive and explanatory objective, with a hypotheticaldeductive method and bibliographic and documentary technique, including official documents of the National Council of Justice, for the years 2017 to 2019.Downloads
