Abstract

The article deals with the need to exercise the access to the Labor Court responsibly, given the new scenario of the Labor Reform and the implementation of the burden of lossrelated to the attorney's fees and the finesfor bad faith litigation. The objective is to demonstrate how it is possible to exercise this responsible litigation, through the observance of binding precedents regarding the right and the use of the anticipated production of evidence in relation to the disputed facts in the new scenario of labor procedure. The result will be an awareness of the litigants to exercise an access to the legal system in a responsible way, through a methodology that starts from the technical analysis regarding the introduction, the concepts, the distinctions, the effects and the functions of the institutes.
