ONLINE DISPUTE RESOLUTION AND DISPUTE RESOLUTION: FROM QUALITY TO EFFECTIVENESS OF RIGHTS

This article seeks to address the issue of Online Dispute Resolution from its ability to qualitatively resolve conflicts and grant effectiveness in restoring the injured right. Therefore, the investigation started from historical premises about conflict of interests, access to justice, process and reality of modern society, with social practices in a digital environment. In these terms, the objective was to discuss the rights capable of resolving conflicts online, as well as the suitability of the process installed there and the respect for fundamental rights and guarantees, predicates carrying out a process, in fact, fair. As a result, among others, the still incipient legislative regulation of the regarding to procedural aspects in the solution of conflicts online, especially in Brazil, favoring the low perception of respect for the postulates due to legal process, as well as the guarantee of satisfaction rights in that environment discussed and decided. The methodologies used were descriptive and bibliographical, suitable for the investigation and description of the object as well as literary support, which is still under construction on the subject.Downloads
