THE USE OF NUDGES IN MEDIATION SESSIONS AS AN INSTRUMENT OF THE NATIONAL POLICY FOR THE PROPER HANDLING OF CONFLICTS

This article aims to analyze the use of nudges in mediation sessions based on behavioral economics studies. To attempt such an approach, the concept of nudge is presented, discussing how an interdisciplinarity can help in the search for consensus in mediation arrangements. Bibliographic research was used, as well as the hypotheticaldeductive method. It is concluded that the use of nudges in autocomposition methods helps the parties to reach an agreement, respecting fundamental rights and expressing a change in the culture of litigation in our legal system.Downloads
