Abstract

This article analyzes the possibility of atypical judicial procedural flexibility, in the light of the current Civil Procedure Code. Its fundamental premise is the constitutional guarantee of access to justice, demanding the conformation of the procedural structure in order to meet the needs of substantive law and the circumstances of the concrete case. In this context, the possibility of adjusting the procedure in cases not provided for in the law plays a fundamental role in the effectiveness of access to justice. We demonstrate in the article that, through the systematic interpretation of the provisions of the Civil Procedure Code, in line with the constitutional guarantee of access to justice, it is possible to vary the procedure, punctually deviating from the standard procedural route. The deductive methodology was used.
