Abstract

This research aims to analyze the enforceability of electronic contracts. Using the deductive method with doctrinal review and analysis of STJ jurisprudence as a methodological option, it starts with the study of the impacts of technology on the process, placing electronic contracts among the consequences of technological advances and contemporary socioeconomic relations. Then, the executive title, whose requirements are imposed by law, is studied, in order to demonstrate that there are no obstacles for the title to exist electronically. In the end, it is concluded that the electronic title is enforceable due to the equivalence of the digital certification to the signature of the witnesses, according to the position of the STJ.
