Abstract

This work analyzes the possible interpretations of the concepts of case law, precedent and “Súmula” in the Brazilian Code of Civil Procedure of 2015 (CPC/2015), by reviewing the literature on the subject and considering the purposes stipulated by the legislator. It concludes that the different degrees of binding effects of the provisions contained in article 927 are related to its joint interpretation with other procedural institutes. It is also observed that the provision of article 927 is essentially symbolic, reinforcing that the CPC/2015 has a much more managerial purposes than that of an effective search for mechanisms that deal with normativity and strengthening of precedents.
