Abstract

The present article, based on a bibliographical research, intends to analyze the still controversial aspects related to the conduct adjustment term. First, after a brief description of statistical data related to Brazilian courts, which demonstrate the difficulties arising from excessive judicialization in the country, considerations are made about the usefulness of the adjustment term for the consensual solution of collective disputes. Furthermore, this text also seeks to analyze the main current issues related to the conduct adjustment term, including through the appreciation of fundamental aspects for an adequate and efficient use of the aforementioned adjustment.
