COOPERATION AGREEMENT AND CONFIDENTIALITY: ANALYSIS OF THE LEGAL CONSEQUENCES OF UNDUE DISCLOSURE OF THE AGREEMENT AND THE CONTENT OF THE DELATOR'S STATEMENTS IN PERSPECTIVE OF THE ANTI-CRIME PACKAGE

This article aims to discuss the topic of confidentiality of the cooperation agreement and the consequences derived from its leakage. For this purpose, the legal regime of publicity of procedural acts in the national order is examined, with specific analysis of the cooperation agreement and the modifications of Law 13.964/19. Therefore, the hypotheticaldeductive method is used, formulating the hypothesis that the violation of secrecy, by any of the parties to the agreement, leads to the illegality of the evidence. In addition, the research was conducted using the technique of bibliographic review, with analysis of articles and legal works that address the cooperation agreement, as well as understanding the jurisprudence of the Superior Courts.Downloads
