Abstract

In this article, we will examine the technique of repetitive appeals and the theory of the instrumentality of the procedure. We will conclude that this mechanism does not fulfill the social scope of the process, as it is unable to generate social peace, resolving conflicts quickly and definitively, promotes radical changes in the dynamics of the Judiciary and in its relations with other powers, impacting the political scope of the process, and brings about profound changes in its legal scope, altering what we understand by adjudication and the role played by judges in the creation and application of law.
