Abstract

This essay aims to i) identify the proper hermeneutics for the Code of Civil Procedure article 937, VIII; and ii) investigate which courts expressly regulate, in the Internal Regulations, the possibility of oral arguments in the judgment of interlocutory appeal against decisions that deal with part of the merits. At the end it is possible to conclude that a) the proper hermeneutics of the device of the art. 937 leads to the admissibility of oral argument in such cases; b) as 100% of TRFs and 70% of TJs applies the command of the section in question, there is a lack of interest in assuring such right, ratifying the mistake committed by the lawmaker.
