THE NEED FOR CONFESSION AS A REQUIREMENT FOR THE CRIMINAL NON-PERSECUTION AGREEMENT AND THE REPERCUSSIONS PRODUCED IN THE CRIMINAL PROCESS AND THE OTHER BALLS OF LAW

The purpose of this essay is to discuss the legislative changes brought by law 13.964/2019, in particular the non-criminal prosecution agreement, which appears as an extension of bargained justice in Brazil, having as one of its requirements the need for formal and detailed for the granting of the benefit by the State. Thus, the person investigated who accepts the agreement must prepare a term of confession including all the circumstances in which the alleged illegal act occurred. However, some issues must be examined more carefully, in particular the requirement for confession and the possible consequences caused in the criminal process itself and also in other legal spheres. Thus, using a hypothetical-deductive methodology and extensive bibliographic review, as well as analyzing possible legal situations and their repercussions, we will seek to demonstrate the positive and negative aspects of this modality. In addition, the probable consequences of the confession will be examined under the terms in which it was inserted in the Brazilian criminal procedural law.Downloads
