Abstract

This article seeks to analyze the divergences and congruencies of the common law and civil law systems, in order to observe how the elements of the first one were incorporated in the Brazilian Code of Civil Procedure issued in 2015. Having established these theoretical bases and Based on the analysis of Themes 99 and 112, ruled by the Superior Court of Justice through the procedure of repetitive appeals, this study aims to observe how the case law elements are normally applied Brazil.
