Abstract

This article is about the relation between the functioning of the process and the search for the truth, understood as the correspondence of the facts announced with the facts that occurred in the world. Emphasizing that the process lives with epistemic limitations, the article argues that its existence as a means for the affirmation of the law and participation of those interested in defining their rights demands the truth as a regulatory ideal and requires that judicial action be based on rationality criteria. This work also brings some examples in the Code of Civil Procedure that reflect its correspondentist and rationalist vocation.
