THE USE OF JURIMETRY IN PRIVATE LAWYING TO PREDICT THE MOST COMMON RESULTS OF OBLIGATIONS/CONTRACTS IN THE PRIVATE LAW CHAMBERS OF CEARÁ COURT OF JUSTICE

The present study proposes to respond to the following research problem: Based on jurimetry, is it possible to identify similar criteria in the determination of moral damages by TJCE private chambers decisions on obligations / types of contracts, as it is the most recurring subject in Ceará Court of Justice? Would the use of this tool help in the practice of private law? As methodology approach, the study is based on bibliographic searches and, to the case study, the Decision Analysis Methodology, making quantitative and qualitative approaches. It is concluded that it is possible to identify similar criteria in the determination of moral damages by the collegiate decisions of the Private Chambers of Ceará Court of Justice, even though the jurisprudence of the state court is not uniform. The incorporation of jurimetry as a tool in the lawyer's daily life provides a probabilistic view of interaction phenomena in the legal context, improving professional performance.Downloads
