Abstract

The non-prosecution agreement constitutes a modality of consensual justice, whose requirement of confession needs to be analyzed. In addition to constituting a flexibilization of fundamental rights, confession represents a remnant of the inquisitorial culture. Furthermore, in view of the conclusion of the criminal investigations and existing enouth elements for the complaint, the question is: would confession be an (im)dispensable requirement for the celebration of the ANPP? The work was structured by the descriptive and partially exploratory method in order to study the ANPP and the consequences that the confession imposes on the accused. In the end it was possible to conclude that the requirement of confession is riddled with unconstitutionality.
