EL RECURSO DE PROTECCIÓN COMO ANTI-SUIT INJUNCTION Y ANTI-ARBITRATION INJUNCTION EN EL ARBITRAJE COMERCIAL INTERNACIONAL

The present study examines the protection action in the context of international commercial arbitration, analyzing its function as a mechanism for anti-suit injunction and anti-arbitration injunction. The issue at hand is how this remedy can be used by the parties to prevent the continuation of judicial or arbitral proceedings in non-competent jurisdictions, as well as to safeguard the jurisdiction granted by the parties to an arbitral tribunal. The study concludes that, although the protection action is the only tool within the Chilean legal system capable of serving the function of an anti-suit injunction, its application presents significant challenges that must be considered in international commercial arbitration.
