Abstract

It is an article intended to differentiate the expressions “precedent”, “jurisprudence” and “summary”, conferring its real content and scope in the scope of Brazilian Civil Procedural Law. The article also sought to focus on the binding effect of decisions handed down mainly by the Superior Courts and the Supreme Constitutional Court, from the analysis of specific themes and institutes, embodied in the guidelines of the Plenary or the Special Body of the Courts, of the Incident of Resolution of Repetitive Demands, the right to Complaint, the control of constitutionality, the binding precedents, as well as the ancident of assumption of jurisdiction. It can be concluded that the binding nature of the application of a precedent is limited to the determining grounds of a decision (ratio decidendi). The research method employed was a qualitative analysis of the collected bibliographic material.
