Abstract

This paper seeks to analyze the phenomenon of activist decisions, their formation and especially their impacts within a constitutional system of primacy of qualitative access to justice. Seeking to analyze the phenomena of judicial activism and underground jurisdiction, a consequence of the first, due to the activity of public agents, especially magistrates. It concluded that Law is a mere instrument for maintaining power and not a means of balancing disparate social relations as proposed in the Constitution of the Republic of 1988 (CRFB/88). The methodology used in this study was documental theory, with deductive technique.
