RESUMO: O artigo procura demonstrar que, no direito contemporâneo, torna-se vã a tentativa de ordenar e prever todas as situações humanas em torno de princípios abstratos, desencarnados da real situação da pessoa humana. A determinação da responsabilidade pressupõe, assim, um procedimento racional que não se satisfaz com a subsunção, mas é mais sofisticado, pois exige a consideração de dois momentos. O primeiro momento considera um princípio moral universal: a ação para ser moral deve ser universalizável não negando o respeito devido a todos os indivíduos; o segundo momento considera que as ações somente serão responsáveis e boas quando avaliam as condições e as possíveis consequências da intervenção no mundo da vida. Esse é o grande desafio para a teoria da responsabilidade na sociedade tecnocientífica: considerar a dignidade da pessoa humana como a categoria primordial da Bioética, a servir como princípio em torno do qual se procura responder à pergunta sobre o tipo de pessoa que queremos ser e qual a sociedade que pretendemos construir.

ABSTRACT: This paper argues that, in contemporary law, becomes vain the attempt to order and predict all human situations around abstract principles, disembodied from the real situation of the human person. Determining responsibility thus presupposes a rational procedure that is not satisfied with the subsumption, but it is more sophisticated, because it requires consideration of two moments. The first moment considered a universal moral principle: the action to be moral is to be universalized, not denying due respect to all individuals; the second moment considers that the actions will only be responsible and good when evaluating the conditions and the possible consequences of intervention in the life world. That is the great challenge for the theory of liability in technoscientific society: consider the dignity of the human person as the primary category of Bioethics, to serve as a principle around which it seeks to answer the question about the type of person we want to be and what society we want to build.
