La jurisprudencia constitucional por precedentes en México: retos y propuestas

Resumen
El presente trabajo, se encuentra dirigido a realizar un análisis crítico de la Jurisprudencia en México, con énfasis en la nueva modalidad de creación de Jurisprudencia por el sistema de precedentes, establecida mediante reforma a la Constitución Política de los Estados Unidos Mexicanos, publicada en el Diario Oficial de la Federación, con fecha 11 de Marzo de 2021 (DOF, 2021); con la finalidad de destacar los retos que se desprenden de esta nueva forma de creación de jurisprudencia constitucional, de cara a la consolidación del paradigma del Estado Constitucional y Convencional de Derecho. En concreto, se establecerán una serie de argumentos sobre la posibilidad de que la jurisprudencia aprobada por la Suprema Corte de Justicia de la Nación (SCJN), tenga efectos generales para todas las autoridades del país en el ámbito de sus respectivas competencias, y no sólo para las autoridades de carácter judicial. Por lo que el análisis y desarrollo del presente texto, se hará bajo el método de estudio de caso, y el correspondiente análisis e interpretación del marco constitucional y legal que regula la jurisprudencia en México (método exegético).

Abstract
This paper is aimed at making a critical analysis of the Jurisprudence in Mexico, with emphasis on the new modality of creation of Jurisprudence by the system of precedents, established by means of a reform to the Political Constitution of the United Mexican States, published in the Official Gazette of the Federation, on March 11, 2021 (DOF, 2021); with the purpose of highlighting the challenges that arise from this new form of creation of constitutional jurisprudence, in the face of the consolidation of the paradigm of the Constitutional and Conventional State of Law. Specifically, a series of arguments will be established regarding the possibility that the jurisprudence approved by the Supreme Court of Justice of the Nation (SCJN) has general effects for all the authorities of the country within the scope of their respective competences, and not only for the judicial authorities. Therefore, the analysis and development of this text will be done under the case study method, and the corresponding analysis and interpretation of the constitutional and legal framework that regulates the jurisprudence in Mexico (exegetical method).
