Novo paradigma das decisões judiciais na sociedade pós-moderna / New paradigm of judicial decisions in postmodern society

Analisa as novas relações sociais à luz da Modernidade e da Pós-Modernidade, bem como do positivismo jurídico e pós-positivismo, que, desde o século XX, influenciam a Ciência Jurídica, principalmente no que concerne à interpretação do Direito. É notável a influência, na contemporaneidade, do modelo pós-positivista para justificar as decisões judiciais na busca do justo, utilizando-se, em regra, para a solução de casos mais complexos, conceitos abstratos e princípios implícitos à revelia da lei e da Constituição, desaguando, não raro, no chamado ativismo judicial. Será tratado, primeiramente, sobre a Modernidade e Pós-Modernidade e sua influência no Direito. Em seguida, examinam-se as características dos paradigmas do positivismo e pós-positivismo. E, posteriormente, busca-se compreender o novo paradigma adotado nas decisões judiciais na chamada Pós-Modernidade com crítica ao ativismo judicial. Portanto, é defendida neste experimento acadêmico a ideia de que não houve uma superação do positivismo jurídico pelo pós-positivismo, mas sim um aperfeiçoamento, o qual requer, por parte dos intérpretes, fundamentações consistentes, respeitando as balizas do Estado Democrático de Direito.

Abstract
It analyzes the new social relations in the light of Modernity and Post-Modernity, as well as of legal positivism and post-positivism, which, since the XX century, have influenced Juridical Science, mainly in what concerns the interpretation of Right. The influence of the post-positivist model to justify its judicial decisions in the search for the just is notable, using, as a rule, the solution of more complex cases, abstract concepts and implicit principles in the absence of the law and the Constitution , Flowing, not infrequently, in the so-called judicial activism, incompatible with the Democratic State of Right itself. It will be treated, firstly, about Modernity and Post-Podernity and its influence on Right. Next, the characteristics of the paradigms of positivism and post-positivism are examined. And, later, it is tried to understand the new paradigm adopted in the judicial decisions in the call Post-Modernity. In this academic experiment, therefore, the idea was defended that there was no overcoming of legal positivism by post-positivism, but rather an improvement, which requires consistent interpretations by the interpreters, respecting the beacons of the Democratic State of Right.
