Do Controle Prévio dos Atos de Concentração pelo CADE. Do Papel da Propriedade Industrial na infração à ordem econômica e nos atos de concentração.

This article aims to examine the prior control of concentration acts by the Administrative Council for Economic Defense (CADE) and the role of industrial property in economic order infractions and concentration acts. The research method used was an integrative review of literature and case law from a deductive perspective. We address restrictive competition acts and concentration acts through structural control and conduct control. We discuss the role of Industrial Property in economic order infractions and concentration acts subject to prior control by CADE. We analyze CADE's prior control of concentration acts. We conclude that CADE's preventive structural control is essential to ensure the effectiveness of conduct control of economic agents' behaviors, ensuring that concentration acts do not harm competition and free enterprise. Intellectual property rights are compatible with Antitrust Law, and CADE has the authority to intervene in cases of market-related infractions involving these rights. The prior control of concentration acts by CADE ensures the effectiveness of preventive control, guaranteeing free competition and preventing economic power abuse, while providing legal certainty for companies and protecting the public interest.
