Resumo: Este ensaio investiga o enigma da produtividade do direito: a produção de efeitos reais atribuídos aos enunciados jurídicos, que não raro foi explicada pela teoria dos atos performativos. Explorando afinidades, analogias, impasses e paradoxos, o problema dos performativos é retomado a partir do entrelaçamento analítico de três campos: linguagem, técnicas computacionais e direito. Como resultado, o ensaio demonstra, por meio do conceito de palavra de ordem, de Deleuze e Guattari, que performativos, algoritmos e enunciados jurídicos têm seu funcionamento efetivo melhor explicado pelos agenciamentos sociais dos quais dependem.

Abstract: This essay investigates the enigma of the productivity of law: the production of real effects attributed to legal utterances, which has often been explained by the theory of performative acts. Exploring affinities, analogies, impasses and paradoxes, the problem of performatives is resumed from the analytical intertwining of three fields: language, computational techniques and law. As a result, the essay demonstrates, through the concept of order-words, by Deleuze and Guattari, that performatives, algorithms and legal utterances have their effective functioning better explained by the social agencies on which they depend.
