Resumo: A jurisprudência dos sistemas regionais de direitos humanos tem contribuído para o desenvolvimento de padrões sobres os direitos das pessoas privadas de liberdade e produzem impacto além das respectivas bases territoriais, exercendo influência na jurisprudência de outros sistemas regionais. O presente artigo aborda o controle da execução penal e a influência mútua entre os Sistemas Europeu e Interamericano de Direitos Humanos, no que diz respeito aos direitos das pessoas privadas de liberdade, especialmente no que se refere ao controle da superpopulação carcerária.

Abstract: The caselaw of the regional human rights systems has contributed to the development of standards in respect to the rights of incarcerated people, and it has an impact beyond their territorial bases, exerting influence on the jurisprudence of other regional systems. This article deals with the mutual influence between the European, and Interamerican Human Rights Systems concerning the rights of incarcerated people, especially with regard to the control of prison overcrowd.
