Resumo: Este artigo tem como objeto a participação popular na tomada de decisões em âmbito das agências reguladoras no Brasil, inserida na problemática caracterizada por eventuais incompatibilidades entre critérios de legitimidade democrática e o tratamento técnico de assuntos econômicos. Tem-se dois objetivos principais, que consistem em investigar 1) se as normas nacionais contemplam um processo de participação popular apto a interferir na elaboração de políticas econômicas regulatórias; e 2) a relação de tal modelo de participação com o conceito de democracia. Para tanto, dispõe-se de procedimento hipotético-dedutivo em pesquisa documental e bibliográfica, respectivamente mediante análise da Lei n. 13.848/2019 – principal diploma no Brasil sobre o objeto inquirido – e da obra de pesquisadores sobre a análise econômica do direito e políticas regulatórias, sobretudo a partir do pensamento de Richard Posner e os conceitos que este apresenta acerca da democracia. A conclusão é que a Lei n. 13.848/2019 oferece mecanismos para equilibrar a tensão apontada entre legitimidade e tecnicidade e que não encontra rejeição por quaisquer dos conceitos de democracia abordados.

Abstract: This article deals with the popular participation concerning the rulemaking within the scope of regulatory agencies in Brazil, surrounded by the problem of possible incompatibilities between the criteria of democratic legitimacy and the technical approach often required by economic matters. The two main objectives of this survey consist of investigating 1) whether the Brazilian legislation offers some process of popular participation able enough to interfere in the making of regulatory economic policies; and 2) the relation between such a model of participation and the concepts of democracy. In order to achieve these goals, the survey employs hypothetical-deductive method in documental and bibliographic research, respectively through the analysis of Act n. 13.848/2019 – the main piece of legislation in Brazil on the object inquired – and the work of researchers on the economic analysis of law and regulatory policies, especially resorting to the work by Richard Posner and the concepts he presents about democracy. The conclusion is that the Act n. 13.848/2019 offers mechanisms able to balance the underlying tension between legitimacy and technicality and that it is not incompatible with any of the concepts of democracy addressed.
