Resumo: Esta pesquisa tem por escopo investigar as consequências das alterações promovidas na Lei de Introdução às Normas do Direito Brasileiro pela Lei número 13.655, de 25 de abril de 2018, destacando-se o artigo 28, que versa sobre a interpretação a ser conferida ao dolo e à culpa nos casos de responsabilização de agentes públicos. O objetivo é verificar a adequação dessa modificação à Lei de Improbidade Administrativa, a partir das concepções teóricas da teoria do discurso, de Günther. Para tanto, foi realizada uma pesquisa bibliográfica, jurisprudencial e legislativa, adotando-se o método dedutivo, e como método de procedimento o monográfico, já que o objetivo era propiciar uma reflexão à luz da teoria do discurso. A conclusão é a de o novel art. 28 injetado na Lei de Introdução às Normas do Direito Brasileiro não repercute de forma direta em relação à Lei de Improbidade Administrativa, quando analisado sob os auspícios do discurso de justificação. Contudo, ao se aperceber a alteração legislativa a partir do discurso de aplicação, tem-se que, com relação aos tipos ímprobos que exigem a conduta dolosa, há reflexos interpretativos a serem considerados.

Abstract: This research presents a brief investigation about the consequences of the changes promoted in the Law of Introduction to the Brazilian Law by Law number 13.655, of April 25, 2018, highlighting article 28, which is related to the interpretation to be given to willful misconduct and guilt in cases of accountability of public agents. The research’s problem is to investigate the adequacy of this modification to the Administrative Improbity Law, based on the theoretical conceptions of Günther’s argumentation theory. In order to seeking the answer, a bibliographical, legislative e jurisprudence research was done using the deductive method, and as regards the procedure, the monographic method was chosen, since the objective was to provide a reflection in the light of the argumentation theory. The conclusion is that the new art. 28 injected into the Law of Introduction to the Rules of Brazilian Law has no direct impact in relation to the Law of Administrative Improbity, when analyzed under the auspices of the discourse of justification. However, when analyzing the legislative change from the application discourse, it is clear that, in relation to the strange types that require voluntary conduct, there are interpretative reflexes to be considered.
