Resumo: A pesquisa em tela, fazendo uso de uma metodologia de análise qualitativa, usando-se os métodos de abordagem hipotético-dedutivos de caráter descritivo e analítico, adotando-se técnica de pesquisa bibliográfica, tem por desiderato investigar o instituto do emprego público em comissão no âmbito da Administração Pública Indireta, considerando a existência de teses antagônicas quanto à constitucionalidade daquele tipo de função. Analisa-se, para tanto, o artigo 37, inciso II, da Constituição Federal, além do hodierno posicionamento jurisprudencial e doutrinário correlatos ao assunto. Acolhido o argumento da corrente que positiva, constata-se ainda a existência de outros dois raciocínios, ambos também concernentes ao amparo jurídico para a gênese de tal modalidade de emprego na esfera pública.

Abstract: On-screen research, using a qualitative analysis methodology, using the hypothetical-deductive approaches of a descriptive and analytical character, adopting a bibliographic research technique, has as a reason to investigate the institute of public employment in commission in the scope of the Indirect Public Administration, considering the existence of opposing theses regarding the constitutionality of that type of function. Therefore, article 37, item II, of the Federal Constitution is analyzed, in addition to the current judicial and doctrinal position related to the subject. Having accepted the argument of the current that positive, it is still verified the existence of two other reasonings, both also concerning the legal support for the genesis of such modality of employment in the public sphere.
