A CLÁUSULA SOCIAL NO COMÉRCIO INTERNACIONAL ATUAL: DO MULTILATERALISMO AO REGIONALISMO

A interação entre comércio e direitos trabalhistas nem sempre foi considerada harmoniosa. Por um lado, a busca pela obtenção de vantagens comerciais a menores custos é, algumas vezes, conflituosa com os ideais de promoção de padrões laborais. Por outro, a não conciliação entre esses dois fatores é classificada por alguns países, no âmbito do contexto multilateral do comércio, como uma prática de dumping social. O objetivo do presente trabalho é estudar o atual tratamento das cláusulas sociais nas sistemáticas da União Europeia e dos Estados Unidos, promover análises e realizar comparações entre os dois modelos. O primeiro capítulo do artigo analisará o conceito de cláusula social, realizará o histórico do tema no âmbito multilateral, discutirá os motivos de sua não adoção pela OMC e avaliará quais os perigos de sua inserção ou não inserção no contexto multilateral do comércio. O segundo capítulo, por sua vez, investigará os standards trabalhistas existentes em acordos comerciais internacionais dos Estados Unidos e da União Europeia e promoverá considerações sobre eles.
