O DIREITO À ADAPTAÇÃO RAZOÁVEL E A TEORIA DA DISCRIMINAÇÃO INDIRETA: UMA PROPOSTA METODOLÓGICA.

O estudo tem por objetivo definir os contornos do chamado direito à adaptação razoável no Brasil. Neste sentido, discorro inicialmente acerca dos fundamentos deste direito em uma perspectiva filosófica focada, especialmente, na teoria do reconhecimento desenvolvida nas últimas décadas. Em seguida, analiso especificamente o fenômeno da discriminação indireta, propondo parâmetros para sua identificação e entendendo-o como as formas de discriminação causadas por medidas, práticas ou normas que, apesar de aparentemente neutras, produzem substancial privação e negação de direitos de minorias e grupos marginalizados. Partindo disto, analiso as características principais do direito à adaptação razoável como mecanismo para a superação ou mitigação desta forma de discriminação. Por fim, proponho uma metodologia para identificação da discriminação indireta e aplicação do direito à adaptação razoável que considera três etapas: a identificação do caso prima facie de discriminação indireta; a justificação do ato gerador da discriminação indireta; e a possibilidade de adaptação razoável.
