Critérios de seleção de bens jurídico-penais: Em busca do conteúdo material do princípio da fragmentariedade

Com o presente estudo se pretende analisar a relevância da teoria do bem jurídico no sistema penal brasileiro, notadamente sob o aspecto da influência que deveria ter no momento de elaboração das normas incriminadoras. Procura-se averiguar as importantes contribuições que o bem jurídico-penal pode oferecer na estruturação do sistema normativo punitivo. Procura-se construir um sistema baseado no regime jurídico dos direitos fundamentais e no postulado da proporcionalidade(princípio formal de legitimação) para impor a limitação e a vinculação do legislador ordinário aos ditames da Constituição Federal já no momento de seleção dos bens jurídicos com relevância penal. Sendo a lei penal uma lei restritiva de direitos fundamentais por natureza, pensamos que sua legitimidade depende do resultado do embate entre os valores constitucionais que se almeja proteger mediante a cominação penal e aqueles afetados tanto pelos preceitos primários de proibição quanto pelos secundários de sanção. Somente quando o bem jurídico for constitucional e penalmente relevante, além de preponderar sobre as conseqüências da criminalização diante das circunstâncias fáticas e jurídicas que conformarão o tipo penal é a lei penal pelo primeiro dos requisitos rumo a uma constitucionalidade material.Downloads
