APATRIDIA NA SOCIEDADE COSMOPOLITA: PERSPECTIVAS PARA A EFETIVAÇÃO DOS DIREITOS HUMANOS DOS APÁTRIDAS

Este artigo estuda a apatridia e perspectivas para a efetivação dos direitos humanos das populações apátridas. Por meio de pesquisa bibliográfica e documental, objetiva-se analisar o paradoxo da existência de apátridas na sociedade cosmopolita, em que há a busca constate pelos direitos humanos. Por quais razões ainda existem apátridas no mundo? Quais ações são necessárias para erradicar a apatridia? A importância da temática reside no fato de que relatórios das Nações Unidas e demais organizações internacionais mostram que é crescente a quantidade de apátridas no mundo, condição que gera a necessidade de medidas urgentes por parte dos Estados. Utiliza-se como referencial teórico a Metateoria do Direito Fraterno de Eligio Resta, partindo-se da ideia de fraternidade como um anacronismo que auxilia a desvelar o paradoxo dos apátridas e enxergar novas realidades para compreender o outro. O artigo é divido em quatro tópicos que se relacionam com os pressupostos elencados na Metateoria do Direito Fraterno: conceito e origem dos apátridas, nacionalidade, causas da apatridia e perspectivas para extinguir a apatridia. Por meio deste estudo, observa-se que a apatridia, embora presente na história da humanidade, é um desafio atual às nações. Contudo, as práticas efetivadas pelas organizações internacionais e pelos Estados mostram-se fundamentais para a erradicação da apatridia.
